Terms of Use

1. Acceptance of these Terms

By accessing or using the Payday CF website, application, or related services, you agree to be bound by these Terms of Use and the Privacy Policy, which is incorporated by reference where applicable.

If you do not agree to these Terms, do not access or use Payday CF. If you are using the service on behalf of another person or organization, you represent that you have authority to accept these Terms on its behalf.

2. Description of the Service

Payday CF helps users organize paycheck windows, income, bills, savings transfers, debt payments, hold-over funds, and projected cash flow. The service may include calculations, estimates, suggestions, reminders, shared budgets, statement uploads, and related planning features.

Elucidatix may change, add, or remove features at any time. A feature’s availability may vary by device, platform, account, or release.

3. Planning tool disclaimer

Payday CF is an organizational and planning tool only. It is not financial, investment, tax, legal, credit, banking, or other professional advice.

Payday CF does not access or control bank accounts or move money unless a future feature explicitly states otherwise. The service does not guarantee that you will have enough money, avoid overdrafts, pay bills on time, avoid shortages, or achieve any financial result. Estimates and planning suggestions are based on information entered by you and may not reflect your actual financial situation.

4. User responsibility and verification

You are responsible for entering accurate, complete, and current information. You must independently verify balances, income, bills, due dates, transfers, debt obligations, and suggestions before making financial decisions.

You remain responsible for your own financial decisions and obligations. Projections may be incomplete or inaccurate if information is missing, outdated, entered incorrectly, or not updated when circumstances change.

5. Accounts and account security

You must provide accurate information when creating or maintaining an account and keep your account credentials and authentication methods secure. You are responsible for activity under your account, except to the extent that applicable law provides otherwise.

If you believe your account has been compromised or used without permission, contact info@elucidatix.com promptly through the Support page. Do not send passwords, authentication codes, private keys, or security tokens in an email.

6. Shared budgets and invitations

Only invite people you trust to a shared budget. Depending on the feature permissions, shared-budget members may be able to view or modify information in that budget.

You are responsible for reviewing who has access and removing access when appropriate. Elucidatix is not responsible for a disclosure or change made by a person you invited or otherwise authorized to access a shared budget, to the fullest extent permitted by applicable law.

7. Notifications and reminders

Notifications and reminders are convenience features only. They may be delayed, missed, disabled, or affected by device, operating-system, network, battery, or permission settings.

Do not rely solely on Payday CF notifications for bill payment or other time-sensitive obligations. You remain responsible for tracking and meeting your obligations.

8. Acceptable use

You may not use Payday CF to:

• Engage in illegal, fraudulent, deceptive, or abusive activity.
• Access another person’s account or budget without authorization.
• Interfere with the service or attempt to bypass, disable, or defeat security controls.
• Upload malicious code, harmful content, or material that violates another person’s rights.
• Reverse engineer, decompile, or otherwise attempt to derive source code, except where legally permitted.
• Provide professional advice to others while representing Payday CF as the source of that advice.

9. User content and feedback

You retain ownership of the information and other content you submit to Payday CF. You grant Elucidatix a limited right to host, process, display, synchronize, and back up submitted information as necessary to provide, maintain, secure, and improve the service, consistent with the Privacy Policy.

If you submit feedback or suggestions, you permit Elucidatix to use them without restriction or an obligation to compensate you, including to develop or improve products and services.

10. Third-party services

Payday CF may depend on third-party infrastructure, authentication, hosting, notifications, analytics, app stores, or other providers. Those services may be subject to their own terms and policies. Elucidatix does not control every third-party service and is not responsible for its availability or acts, except as required by applicable law.

Information handled by third parties is described in the Privacy Policy.

11. Availability, changes, and suspension

Payday CF may occasionally be unavailable because of maintenance, outages, updates, connectivity issues, or circumstances outside Elucidatix’s control. Elucidatix does not promise uninterrupted or error-free availability.

Subject to applicable law, Elucidatix may suspend or terminate access for violations of these Terms, abuse, security reasons, operational reasons, or other legitimate reasons. After termination, your right to use the service ends. Account information and user content may be deleted or retained as described in the Privacy Policy and as required for legal, security, fraud-prevention, backup, or recordkeeping purposes.

12. Account deletion

You may request or initiate account deletion through the supported in-app or support flow. See the Support page for instructions.

Deletion may require identity verification and may not be immediate or irreversible. Limited information may be retained where legally required or needed for security, fraud prevention, dispute resolution, backups, or recordkeeping, consistent with the Privacy Policy.

13. Intellectual property

The Payday CF software, branding, design, text, and related materials are owned by or licensed to Elucidatix. Subject to these Terms, Elucidatix grants you a limited, non-exclusive, non-transferable right to use the service for its intended purpose.

These Terms do not transfer ownership of user content to Elucidatix.

14. Disclaimers and limitation of liability

To the fullest extent permitted by applicable law, Payday CF is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. Elucidatix disclaims warranties to the extent legally permitted, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, Elucidatix is not responsible for financial decisions, missed payments, overdrafts, fees, losses, inaccurate user data, notification failures, service interruptions, or reliance on projections. This does not exclude or limit liability that cannot legally be excluded or limited.

To the fullest extent permitted by applicable law, Elucidatix will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to Payday CF or these Terms. Elucidatix’s total liability for claims arising from or related to the service will be limited to the amount permitted under applicable law. Nothing in these Terms limits rights or remedies that cannot legally be waived.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Elucidatix and its personnel from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Payday CF, your violation of these Terms, or your violation of another person’s rights. This obligation does not apply to the extent a claim results from Elucidatix’s own gross negligence, willful misconduct, or other conduct for which indemnification cannot legally be required.

16. Governing law and disputes

These Terms are governed by the laws of North Carolina, United States, without regard to conflict-of-law rules, unless applicable law requires otherwise.

Any dispute related to Payday CF or these Terms will be handled in the courts located in Guilford County, subject to applicable law and any rights that cannot legally be waived.

17. Children and minimum age

Payday CF is not directed to children under 13, consistent with the Privacy Policy. The minimum user age for the service is 13. If you do not meet the applicable minimum age or cannot legally agree to these Terms, do not use Payday CF.

18. Changes to the Terms

Elucidatix may update these Terms from time to time. For material changes, Elucidatix may provide notice through the service, by email, or by another reasonable method where required by law. The “Last updated” date will be revised when changes are published.

Where legally permitted, continued use of Payday CF after updated Terms take effect means you accept the changes. If you do not agree to updated Terms, stop using the service.
